1. Introduction
Hot Purple Berry Oyun Yazılım ve Dağıtım Anonim Şirketi ("Hot Purple Berry," "we," "us," or "our") is a mobile game development company incorporated in the Republic of Türkiye. We develop hybrid casual mobile games (the "Games") that are published in cooperation with our publishing partner, Rollic Games Oyun Yazılım ve Pazarlama A.Ş. ("Rollic"), a member of the Zynga and Take-Two Interactive Software, Inc. group of companies.
This Privacy Policy explains what information we collect when you download, access, or play our Games or otherwise interact with us (collectively, the "Services"), how we use and share that information, and the choices and rights you have regarding your information.
Important note about our publisher: Where our Games are published and operated by Rollic, personal data collected through those Games may be processed by Rollic and/or its group companies as a data controller (independently or jointly with us), and Rollic's privacy policy (available at https://www.rollicgames.com/privacy) and/or the Take-Two Interactive privacy policy (available at https://www.take2games.com/privacy) may also apply to your use of those Games. We encourage you to review those policies together with this one.
By downloading, accessing, or using our Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Services.
2. Information We Collect
The information we collect depends on how you interact with our Services. We do not require you to create an account or provide your name or email address to play our Games.
2.1 Information Collected Automatically
When you play our Games, we and our publisher and their integrated technology partners (through the Rollic SDK and related third-party software development kits) may automatically collect:
- Device and technical information: device type, model, and manufacturer; operating system and version; device language and region settings; screen resolution; mobile network or internet service provider; and IP address (which may indicate your approximate, city-level location).
- Device and advertising identifiers: identifiers such as the Apple Identifier for Advertisers (IDFA), Identifier for Vendors (IDFV), and Google Advertising ID (GAID), where permitted by your device settings and applicable law.
- Gameplay and usage data: levels played, progress, scores, session length and frequency, in-game events, feature usage, crashes, and general interactions with the Games.
- Advertising interaction data: which advertisements are served in the Games, and whether and how you view, click on, or otherwise interact with them.
- Purchase data: records of in-app purchases you make (such as the item purchased, price, and transaction time). Payments are processed entirely by the relevant app store platform (Apple App Store or Google Play). We do not collect or store your credit card number, full payment details, or billing address.
2.2 Information You Provide Directly
If you contact us — for example, for customer support, feedback, or a privacy request — we collect the information you choose to provide, such as your email address and the contents of your message.
2.3 Information from Third Parties
We may receive aggregated or campaign-level information from the app store platforms, our publisher, and advertising or analytics partners, for example to measure the performance of our Games and marketing campaigns.
3. How We Use Information
We use the information described above to:
- Operate, provide, and maintain the Games, including saving your game progress on your device;
- Fulfill in-app purchases and deliver purchased content;
- Analyze and improve the Games, including balancing gameplay, fixing bugs and crashes, and developing new features and games;
- Display advertising in the Games, including (where you have given consent or otherwise permitted it through your device settings) personalized advertising, and measure the effectiveness of advertising;
- Market and promote our Games, including measuring and attributing the performance of our advertising campaigns on third-party platforms;
- Provide customer support and respond to your inquiries and requests;
- Protect the safety, security, and integrity of the Services, including detecting and preventing fraud, cheating, and abuse;
- Comply with legal obligations and enforce our terms and policies.
4. Legal Bases for Processing (EEA, UK, and Similar Jurisdictions)
Where the EU/UK General Data Protection Regulation ("GDPR") or similar laws apply, we process your personal data on the following legal bases:
- Performance of a contract: to provide the Games and Services you request, including fulfilling in-app purchases;
- Legitimate interests: to operate, analyze, improve, and secure our Games, to prevent fraud, and to conduct non-personalized (contextual) advertising and basic measurement, where such interests are not overridden by your rights and freedoms;
- Consent: for personalized advertising and the use of advertising identifiers where consent is required (for example, through your device's App Tracking Transparency prompt on iOS or an in-game consent flow). You may withdraw consent at any time as described in Section 7;
- Legal obligation: to comply with applicable laws, regulations, and lawful requests from authorities.
5. How We Share Information
We may share your information with:
- Our publisher and its group companies: Rollic and its affiliates within the Zynga / Take-Two Interactive group, which publish, operate, and monetize our Games and process data as described in their own privacy policies;
- Advertising and monetization partners: third-party advertising networks, mediation platforms, and attribution providers integrated into our Games through the Rollic SDK, which may collect device identifiers and advertising interaction data to serve and measure advertisements. These partners process data in accordance with their own privacy policies. A current list of the third-party partners integrated into games published by Rollic is available in Rollic's privacy policy at https://www.rollicgames.com/privacy;
- Analytics providers: services that help us understand how players use our Games so we can improve them;
- Service providers: vendors that provide technical, hosting, customer support, or professional services to us, under obligations to protect your information;
- Legal and safety recipients: courts, regulators, law enforcement, or other parties where we believe disclosure is required by law or necessary to protect our rights, your safety, or the safety of others;
- Business transfers: a successor entity in connection with a merger, acquisition, reorganization, or sale of assets, in which case your information may be transferred as part of that transaction;
- Aggregated or de-identified data: we may share information that does not identify you (such as aggregated statistics) for any lawful purpose.
We do not sell your personal information for money. However, the sharing of device identifiers and advertising data with advertising partners may be considered a "sale" or "sharing" for cross-context behavioral advertising under certain U.S. state laws such as the California Consumer Privacy Act (CCPA/CPRA). See Section 10 for your rights and opt-out choices.
6. Children's Privacy
Our Games are intended for a general audience and are not directed at children. We do not knowingly collect personal information from children under the age of 13 (or the applicable minimum age in your jurisdiction, such as 16 in certain EEA countries) without appropriate consent.
Where required, our Games may include a neutral age screen. If a user identifies as under the applicable age threshold, we and our partners take steps designed to limit data collection from that user — including disabling personalized advertising and limiting the collection of advertising identifiers — consistent with the U.S. Children's Online Privacy Protection Act ("COPPA"), the GDPR, and other applicable laws. Any advertising served to such users is intended to be contextual (non-personalized) only.
If you are a parent or guardian and believe your child has provided personal information to us without your consent, please contact us at info@hotpurpleberry.com and we will take steps to delete such information as required by law.
7. Your Advertising Choices
You can limit the use of your device's advertising identifier for personalized advertising at any time:
- iOS: Our Games will request your permission before tracking via Apple's App Tracking Transparency framework. You can review or change this at Settings → Privacy & Security → Tracking. You can also enable "Limit Ad Tracking" / disable personalized ads under Settings → Privacy & Security → Apple Advertising.
- Android: Go to Settings → Google → Ads (or Settings → Privacy → Ads, depending on your device) to delete or reset your Advertising ID or opt out of ads personalization.
- In-game consent settings: Where an in-game privacy or consent menu is available, you can review and change your advertising consent choices there at any time.
If you opt out of personalized advertising, you will still see advertisements in the Games, but they will not be tailored to your interests.
8. Data Retention
We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including providing the Games, complying with legal, accounting, or reporting obligations, resolving disputes, and enforcing our agreements. When personal information is no longer needed, we delete, anonymize, or securely aggregate it. Retention periods applied by our publisher and third-party partners are governed by their own privacy policies.
9. International Data Transfers
We are based in the Republic of Türkiye, and our publisher, partners, and service providers may be located in Türkiye, the United States, the European Economic Area, and other countries. As a result, your information may be transferred to and processed in countries other than your own, which may have data protection laws different from those in your jurisdiction.
Where required by applicable law (including the GDPR and the Turkish Personal Data Protection Law No. 6698, "KVKK"), we take steps to ensure that such transfers are subject to appropriate safeguards, such as the European Commission's Standard Contractual Clauses, adequacy decisions, explicit consent, or other lawful transfer mechanisms.
10. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Access: to learn whether we process your personal data and to request a copy of it;
- Rectification: to request correction of inaccurate or incomplete personal data;
- Erasure: to request deletion of your personal data;
- Restriction and objection: to request restriction of, or object to, certain processing, including processing based on legitimate interests and processing for direct marketing;
- Data portability: to receive certain personal data in a structured, commonly used, machine-readable format;
- Withdrawal of consent: to withdraw any consent you have given, at any time, without affecting the lawfulness of processing prior to withdrawal;
- Complaint: to lodge a complaint with a supervisory authority, such as your local data protection authority in the EEA/UK or the Turkish Personal Data Protection Authority (KVKK Kurumu).
For residents of California and certain other U.S. states: You may have the right to know what categories of personal information we collect, use, and disclose; the right to delete or correct personal information; the right to opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising; and the right not to be discriminated against for exercising these rights. You can opt out of personalized advertising using the device settings and in-game options described in Section 7, or by contacting us as described below. We do not knowingly sell or share the personal information of consumers under 16 years of age.
For residents of Türkiye: In accordance with Article 11 of the KVKK, you have the right to learn whether your personal data is processed, request information about such processing, learn the purpose of processing and whether the data is used in line with that purpose, know the third parties to whom your data is transferred domestically or abroad, request rectification, deletion, or destruction of your data, object to results arising from automated processing, and claim compensation for damages arising from unlawful processing.

We will respond within the timeframes required by applicable law (generally within 30 days). If your request relates to a Game published by Rollic, we may direct your request to, or coordinate with, Rollic, and you may also submit data requests directly through https://www.rollicgames.com/privacy/request.
11. Data Security
We implement reasonable technical and organizational measures designed to protect your information against unauthorized access, loss, misuse, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
12. Do Not Track
Some browsers and devices transmit "Do Not Track" signals. Because there is no common industry standard for interpreting these signals, our Services do not currently respond to them. You can use the choices described in Section 7 to manage advertising preferences.
13. Third-Party Links and Services
Our Games and Services may contain advertisements for, or links to, third-party websites, apps, or services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will provide notice as required by applicable law (for example, through an in-game notice). Your continued use of the Services after any changes become effective constitutes your acknowledgment of the updated Privacy Policy, to the extent permitted by law.
